{"id":1140,"date":"2026-04-29T17:00:00","date_gmt":"2026-04-29T15:00:00","guid":{"rendered":"https:\/\/offix.solutions\/?p=1140"},"modified":"2026-04-30T09:58:27","modified_gmt":"2026-04-30T07:58:27","slug":"actualite-juridique-avril","status":"publish","type":"post","link":"https:\/\/offix.solutions\/fr\/actualite-juridique-avril\/","title":{"rendered":"Actualit\u00e9 juridique"},"content":{"rendered":"\n<h3 class=\"wp-block-heading\"><strong><strong>Mise \u00e0 jour des heures suppl\u00e9mentaires volontaires<\/strong><\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Dans notre newsletter de mars, nous avions d\u00e9j\u00e0 pr\u00e9sent\u00e9 un aper\u00e7u des principales r\u00e8gles relatives au nouveau r\u00e9gime des heures suppl\u00e9mentaires volontaires.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">L\u2019une des conditions essentielles pour pouvoir prester ces heures suppl\u00e9mentaires volontaires est la conclusion d\u2019un accord avec le travailleur int\u00e9rimaire.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Les accords conclus sous l\u2019ancien r\u00e9gime (c\u2019est-\u00e0-dire avant le 1er avril 2026) restent valables apr\u00e8s le 1er avril 2026. \u00c0 l\u2019issue de cet accord de six mois, il faudra en conclure un nouveau conform\u00e9ment aux nouvelles r\u00e8gles (dur\u00e9e d\u2019un an, prolongation tacite, etc.).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Le probl\u00e8me actuel est que la nouvelle l\u00e9gislation n\u2019a pas encore \u00e9t\u00e9 publi\u00e9e au Moniteur belge. Dans ce contexte, le Gouvernement a ajout\u00e9 une adaptation au projet de loi. Celle-ci pr\u00e9voit le m\u00eame r\u00e9gime transitoire que celui d\u00e9crit ci-dessus, mais pour les accords conclus \u00e0 partir du 1er avril 2026 et ce jusqu\u2019\u00e0 la publication d\u00e9finitive de la nouvelle l\u00e9gislation au Moniteur belge. Ces accords conservent donc \u00e9galement leur validit\u00e9 jusqu\u2019\u00e0 leur date d\u2019expiration pr\u00e9vue.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Si vous souhaitez aujourd\u2019hui recourir au r\u00e9gime des heures suppl\u00e9mentaires volontaires, les options sont les suivantes :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Vous avez d\u00e9j\u00e0 conclu avant le 01\/04 un accord avec vos travailleurs int\u00e9rimaires pour six mois : cet accord continue simplement \u00e0 courir jusqu\u2019\u00e0 son \u00e9ch\u00e9ance. Ensuite, vous conclurez un nouvel accord conform\u00e9ment au nouveau r\u00e9gime (annuel, prolongation tacite, etc.), \u00e0 condition que celui-ci ait entre-temps \u00e9t\u00e9 publi\u00e9.<\/li>\n\n\n\n<li>Vous devez aujourd\u2019hui conclure un nouvel accord et la loi relative aux heures suppl\u00e9mentaires volontaires n\u2019a pas encore \u00e9t\u00e9 publi\u00e9e au Moniteur belge : dans ce cas \u00e9galement, vous pouvez recourir au r\u00e9gime transitoire ci-dessus, en concluant un accord de six mois. \u00c0 l\u2019issue de celui-ci, vous conclurez un nouvel accord selon le nouveau r\u00e9gime (annuel, prolongation tacite, etc.). Une r\u00e9f\u00e9rence sp\u00e9cifique au nombre d\u2019heures suppl\u00e9mentaires volontaires n\u2019est pas requise.<\/li>\n\n\n\n<li>La loi a \u00e9t\u00e9 publi\u00e9e au Moniteur belge et vous devez conclure un nouvel accord : dans ce cas, vous concluez imm\u00e9diatement un accord selon le nouveau r\u00e9gime (annuel, prolongation tacite, etc.). D\u00e8s que cette publication sera effective, nous vous fournirons un mod\u00e8le de cet accord annuel.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Pour plus d\u2019informations, vous pouvez bien entendu toujours contacter l\u2019\u00e9quipe Offix.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Manifestation nationale du 12 mai : impact sur le travail int\u00e9rimaire<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Le mardi 12 mai, les syndicats organisent une manifestation nationale \u00e0 Bruxelles. Qu\u2019est-ce que cela signifie concr\u00e8tement pour les travailleurs int\u00e9rimaires en mission ?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00c9tant donn\u00e9 qu\u2019il s\u2019agit d\u2019une journ\u00e9e d\u2019action et non d\u2019une gr\u00e8ve, l\u2019interdiction d\u2019occuper des travailleurs int\u00e9rimaires ne s\u2019applique pas.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Toutefois, la situation concr\u00e8te doit \u00eatre suivie de pr\u00e8s, m\u00eame en cas d\u2019action ou de manifestation. Une action peut en effet \u00e9voluer en gr\u00e8ve, auquel cas l\u2019interdiction pourrait s\u2019appliquer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Que faire en cas de gr\u00e8ve effective ?<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>L\u2019agence d\u2019int\u00e9rim doit informer l\u2019utilisateur de l\u2019interdiction d\u2019occuper des travailleurs int\u00e9rimaires en cas de gr\u00e8ve effective. L\u2019utilisateur doit informer imm\u00e9diatement l\u2019agence d\u2019int\u00e9rim d\u00e8s qu\u2019une gr\u00e8ve survient dans son entreprise. L\u2019agence d\u2019int\u00e9rim est alors tenue de rappeler imm\u00e9diatement les travailleurs int\u00e9rimaires.<\/li>\n\n\n\n<li>Le secteur recommande par ailleurs de conserver syst\u00e9matiquement toute communication adress\u00e9e aux clients concernant les gr\u00e8ves, ainsi que les r\u00e9ponses des clients. Les syndicats ont en effet indiqu\u00e9 que cela permet de d\u00e9montrer que l\u2019entreprise d\u2019int\u00e9rim a respect\u00e9 ses obligations.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Attention :<\/strong> si les syndicats pr\u00e9sents dans l\u2019entreprise de l\u2019utilisateur donnent leur accord pour maintenir ou engager des travailleurs int\u00e9rimaires en cas de gr\u00e8ve, cela ne l\u00e8ve pas l\u2019interdiction !<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Mais comme indiqu\u00e9, il s\u2019agira tr\u00e8s probablement le 12 mai d\u2019une action\/manifestation et non d\u2019une gr\u00e8ve, de sorte que l\u2019interdiction ne s\u2019applique en principe pas.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><strong>Contr\u00f4les flash de l\u2019inspection sociale en mai : secteurs du transport et du d\u00e9m\u00e9nagement<\/strong><\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Comme vous le savez, les services d\u2019inspection sociale organisent r\u00e9guli\u00e8rement des contr\u00f4les flash via l\u2019organe de coordination SIRS.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ces contr\u00f4les ont principalement un caract\u00e8re informatif et pr\u00e9ventif. Toutefois, en cas d\u2019infractions graves et\/ou r\u00e9p\u00e9t\u00e9es, des proc\u00e8s-verbaux seront dress\u00e9s.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">En mai, les secteurs du transport et du d\u00e9m\u00e9nagement sont concern\u00e9s.
